1. About Games Procurement

Games Procurement (gamesprocurement.com) is operated by DBCG Advisory Pty Ltd (ABN to be confirmed) ("we", "us", "our"). The platform is a procurement marketplace connecting suppliers of goods and services with organisers of major sporting events ("the Platform").

2. Acceptance of Terms

By accessing or using the Platform, including by registering an expression of interest, you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Platform.

3. Registration & Accounts

To register on the Platform, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be authorised to act on behalf of the organisation you represent. We reserve the right to refuse, suspend, or terminate any registration at our discretion.

4. Platform Purpose

The Platform enables suppliers to create profiles and organisers to publish procurement opportunities. Games Procurement acts as a marketplace and does not participate in, guarantee, or take responsibility for any procurement process, contract award, or transaction between suppliers and organisers. All procurement decisions remain the sole responsibility of the publishing organiser.

5. User Obligations

You agree to: provide truthful and up-to-date information in your profile and listings; use the Platform only for lawful purposes related to event procurement; not misrepresent your capabilities, experience, or authority; not upload content that is defamatory, misleading, or infringes the intellectual property rights of any third party; and comply with all applicable laws and regulations in your jurisdiction.

6. Intellectual Property

All content, design, branding, and software on the Platform is owned by or licensed to DBCG Advisory Pty Ltd and is protected by copyright and other intellectual property laws. You retain ownership of content you submit but grant us a worldwide, royalty-free licence to display and distribute that content on the Platform for the purpose of operating the service.

7. Disclaimers

The Platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure. We do not endorse, verify, or guarantee the accuracy of any supplier profile, procurement listing, or other user-generated content. We are not responsible for the outcome of any procurement process facilitated through the Platform.

8. Limitation of Liability

To the maximum extent permitted by law, DBCG Advisory Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, including but not limited to loss of revenue, contracts, data, or business opportunities.

9. InBudget Integration

The Platform may integrate with InBudget Event Planning software to enable organisers to publish procurement opportunities directly. Use of InBudget is subject to separate terms and conditions. We are not responsible for any issues arising from the InBudget integration beyond the functionality of the Platform itself.

10. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason including breach of these Terms. Upon termination, your right to use the Platform ceases immediately.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of New South Wales.

We collect information you provide when registering or using the Platform, including: your name and contact details (email address, phone number); your organisation name and role; details of your products, services, or procurement requirements; your major event experience and supplier capabilities; and any other information you voluntarily provide through the Platform.

We also automatically collect certain technical information when you visit the Platform, including your IP address, browser type, device information, pages visited, and referring URLs.

3. How We Use Your Information

We use your personal information to: operate and improve the Platform; create and manage your account; display your supplier profile or procurement listings to other Platform users; send you notifications about relevant procurement opportunities or supplier registrations; communicate with you about the Platform, including service updates and support; comply with legal obligations; and protect the security and integrity of the Platform.

4. Sharing Your Information

Your profile information (company name, category, experience, contact details) will be visible to other registered users of the Platform. This is a core function of the marketplace. We may also share your information with: service providers who assist us in operating the Platform (hosting, email, analytics); InBudget Event Planning software where you have opted to use the integration; and law enforcement or regulatory bodies where required by law.

We will not sell your personal information to third parties.

5. Data Storage & Security

We store your data using industry-standard cloud infrastructure. We take reasonable steps to protect your personal information from unauthorised access, modification, or disclosure. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

6. Your Rights

You have the right to: access the personal information we hold about you; request correction of inaccurate information; request deletion of your account and personal data; opt out of marketing communications at any time; and lodge a complaint with the Office of the Australian Information Commissioner (OAIC) if you believe your privacy has been breached.
